Terms and Conditions for the Pintado & Lacado Webshop
The following Terms and Conditions govern your use of Pintado & Lacado, including all content, features and services offered on or through www.pintado-lacado.com and its subdomains (the "Webshop"), operated by Kim.Love s.r.o., reg. no. CZ08751404, Švýcarská 2436, Kročehlavy, 272 01 Kladno, Czech Republic.
Please read these Terms and Conditions carefully before using the Webshop. By using the Webshop, you confirm that you accept these Terms and Conditions and agree to comply with them. If you do not agree, you must not use the Webshop.
1. Content of the Webshop All content on the Webshop, including texts, graphics, images and logos, is the property of Pintado & Lacado or its content suppliers and is protected by Czech, European and international copyright laws. Unauthorised use, reproduction or distribution of any content is strictly prohibited.
2. Use of the Webshop You may only use the Webshop for lawful purposes and in accordance with these Terms and Conditions. You agree not to:
- Use the Webshop in any way that violates applicable local, national or international law or regulation
- Use the Webshop to exploit, harm or attempt to exploit or harm minors in any way
- Impersonate Pintado & Lacado, any employee, user or any other person or entity
- Engage in any conduct that restricts or inhibits the use of the Webshop or that could harm Pintado & Lacado or its users
- Use the Webshop in any way that could disable, overload, damage or impair it
- Use any automated tools (robots, spiders, scrapers) to access or copy material from the Webshop without prior written consent
- Introduce viruses, trojans, worms or any other malicious or harmful material
- Attempt to gain unauthorised access to any part of the Webshop, its servers or any connected systems
- Attack the Webshop via a denial-of-service or distributed denial-of-service attack
3. User Account To access certain features of the Webshop, you may be required to create an account. You agree to provide accurate, current and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not use another person's account at any time.
4. Prices and Payment All prices displayed on the Webshop are inclusive of VAT where applicable, in accordance with EU Directive 2006/112/EC. The total price, including all taxes and shipping costs, will be clearly displayed before you complete your purchase.
Payments are processed via Shopify Payments (Stripe), PayPal, Klarna and bank transfer. All payment methods are processed through secure, encrypted systems. Payment is due at the time of placing your order.
If Klarna is used as a payment method, separate terms and conditions apply between you and Klarna. We are not responsible for Klarna's services or policies.
5. Order Confirmation and Contract Formation After placing an order, you will receive an automated order confirmation by email. This confirmation does not constitute acceptance of your order. A binding contract is formed only when we send you a separate dispatch confirmation confirming that your order has been shipped.
We reserve the right to refuse or cancel any order at our discretion, including in cases of pricing errors, suspected fraud or stock unavailability. In such cases, a full refund will be issued promptly.
6. Product Descriptions We make every effort to ensure that product descriptions, images and prices on the Webshop are accurate and up to date. However, we do not guarantee that descriptions are entirely error-free. In the event of a significant error, we will notify you and offer the option to reconfirm or cancel your order.
Colours of products may vary slightly from those displayed on screen due to differences in monitor settings and the handmade nature of our products.
7. Delivery We will deliver to the address provided during the checkout process. We aim to dispatch orders within 1 business day. Estimated delivery times are 2-5 business days, depending on destination. These are estimates only and cannot be guaranteed.
Risk of loss and title for products pass to you upon delivery. If a delivery is unsuccessful due to incorrect information provided by you, any additional costs incurred will be your responsibility.
8. Returns and Refunds Our full Return and Refund Policy, including your statutory 14-day right of withdrawal, is available on our dedicated Returns page. In accordance with EU consumer law, you are entitled to return most items within 14 days of receipt without giving a reason.
Please note that custom-made or personalised crochet toys are exempt from the right of withdrawal under EU Consumer Rights Directive 2011/83/EU.
9. Legal Guarantee All products sold through the Webshop are covered by a 2-year legal guarantee in accordance with EU Directive 2019/771. If a product is defective or does not conform to the contract at the time of delivery, you are entitled to a repair, replacement or refund at no cost to you. Claims must be submitted within two years of receipt of goods.
10. Limitation of Liability To the fullest extent permitted by applicable law, Pintado & Lacado and its officers, directors, employees, agents or suppliers shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Webshop or products purchased through it.
Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by negligence, fraud or any other liability that cannot be limited or excluded under applicable EU law.
11. Indemnification You agree to defend, indemnify and hold harmless Pintado & Lacado, its subsidiaries, officers, directors, employees, agents and suppliers from and against any claims, liabilities, damages, losses or expenses (including reasonable legal fees) arising from your violation of these Terms and Conditions or your use of the Webshop.
12. Online Dispute Resolution In accordance with EU Regulation No. 524/2013, we are required to provide a link to the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
We are willing to participate in alternative dispute resolution proceedings. If you have a complaint that cannot be resolved directly with us, you may also contact the Czech Trade Inspection Authority (Česká obchodní inspekce) at www.coi.cz.
13. Governing Law These Terms and Conditions are governed by and construed in accordance with the laws of the Czech Republic. However, as a consumer based in another EU member state, you retain the protection of the mandatory consumer protection laws of your country of residence.
14. Changes to Terms and Conditions We reserve the right to update these Terms and Conditions at any time. Where changes are material, we will notify you by email or via a notice on the Webshop at least 30 days before the changes take effect. Continued use of the Webshop after that date constitutes acceptance of the updated Terms and Conditions.
15. Termination We reserve the right to suspend or terminate your account and access to the Webshop at any time, with or without cause, and with or without notice. Upon termination, your right to use the Webshop ceases immediately.
16. Entire Agreement These Terms and Conditions constitute the entire agreement between you and Pintado & Lacado regarding your use of the Webshop and supersede all prior agreements, communications and proposals, whether oral or written.
